| dc.description.abstract | Maluliyet raporlarının düzenlenmesi Adli Tıp uygulamalarından biri olup bu konudaki başvuruların gün geçtikçe arttığı gözlenmektedir. Bu raporları düzenlerken farklı yönetmelikler kullanılması ve dolayısıyla farklı oranlar tespit edilmesi, yargılama sürecinde karışıklığa yol açmakta, hak kayıplarının yanı sıra bilirkişiye güvenilirliği zedelemektedir. Raporların sonuçlarında farklı oranlar tespit edilmesi itirazlara yol açarak tekrar tekrar rapor alınmasına ve yargılama sürecinin uzamasına neden olmaktadır. Bu çalışmada bu farkın neden kaynaklandığını, hesaplamada kullanılan cetvellerin eksik yanlarını, rapor hazırlama sürecinde karşılaşılan güçlükleri tespit ederek, çözüm önerilerinde bulunmak amaçlandı. Ege Üniversitesi Tıp Fakültesi (EÜTF) Adli Tıp Anabilim Dalına 1 Ekim 2018-1 Şubat 2019 tarihleri arasında Hukuk Mahkemeleri ve Sigorta Tahkim Komisyonları tarafından gönderilen ve maluliyet raporu düzenlenmesi için başvuran olguların saptanan fonksiyon kısıtlılıkları ve arızalarına göre D ve E Cetvellerine göre hesaplanan oranları ile Engellilik Cetveline göre hesaplanan oran olgu rapor formlarına kayıt edildi. Olgu rapor formlarına kaydedilen veriler SPSS 25.0 istatistik programına kodlanarak girildi ve analiz edildi. Anlamlılık düzeyi p <0.05 olarak kabul edildi. Maluliyet raporu istemiyle başvuran 205 olgunun 148'i (%72,2) erkek, 57'si (%27,8) kadın olup olguların yaşları 10'arlı gruplara ayrıldığında, olguların en çok 20-29 yaş grubunda olduğu, bunu 30-39 yaş grubunun izlediği görüldü. Başvuruların %96,6'sının trafik kazası nedeniyle yaralandığı saptandı. Engellilik Cetveline göre hesaplanan engel oranının, D Cetveli ve E Cetveline göre hesaplanan meslekte kazanma gücündeki azalma oranlarına göre anlamlı olarak (p<0,05) daha az olduğu, D Cetveli ve E Cetveline göre hesaplanan meslekte kazanma gücündeki azalma oranları arasında ise anlamlı bir fark bulunmadığı (p>0,05) görüldü. Sonuç olarak, kullanılan yönetmeliğe göre aynı olgu için farklı oranlar hesaplanmakta, bu durum ödenen tazminat miktarının değişmesine ve kişilerin hak kaybına uğramasına neden olmaktadır. Bu mağduriyetin ortadan kaldırılması adına, hukuk profesyonelleri ve Adli Tıp Uzmanlarının ortak çalışması ile objektif ve standart bir değerlendirme yapılabilmesini mümkün kılan, bilimsel, modern çağın gereksinimlerine uygun, herkes tarafından kabul görecek yeni bir cetvel hazırlanması ya da mevcut cetvellerin güncellenmesi uygun olacaktır. | en_US |
| dc.description.abstract | The preparation of disability reports is one of the forensic medicine practices and it is observed that the applications on this subject are increasing day by day. Due to the use of different regulations in the preparation of these reports, different rates may lead to confusion in the judgment process, as well as loss of rights of the victims and the reliability of the expert. İdentification different rates in the results of the reports leads to objections, resulting in repeatedly receiving reports to the victims and prolonging the judgment process. This research aimt at identifying the reasons of this difference, the missing aspects of the scales used in the calculation, the difficulties encountered during the report preparation process and to propose solutions. Functional limitations and malfunctions of cases determined to Ege University Medical Faculty Forensic Medicine Department between October 1, 2018 and February 1, 2019 by Legal Courts, Labor Courts and Insurance Arbitration Commissions for disability report were determined. The loss amount of the earning power in the profession calculated by to D and E scale and the disability rate calculated according to Disability scale were recorded in the case report forms. Data recorded in case report forms were entered into SPSS 25.0 statistical program and analyzed. Significance level was accepted as p <0.05. Out of 205 patients who applied for disability report, 148 (72.2%) were male and 57 (27.8%) were female. The cases were mostly in the 20-29 age group, followed by the 30-39 age group. 96.6% of the victims were injured due to traffic accidents. The disability ratio calculated according to the disability scale was found to be significantly less (p <0.05) compared to the loss amount of the earning power in the profession calculated according to the D and E scales. There was no significant difference between the rates of loss amount of the earning power in the profession calculated according to Scale D and Scale E (p> 0.05). As a result, different rates are calculated according to the regulation used for the same phenomenon, which results in changes in the amount of compensation paid and loss of rights. In order to eliminate this problem, it would be appropriate to prepare a new scale that will be accepted by everyone, or to update the existing scales, in accordance with the requirements of the scientific, modern era, which enables an objective and standard assessment to be made with the joint work of legal professionals and Forensic Medicine Specialists. | en_US |
